PROJECT OVERVIEW
In April 2005, the County Executive announced that the County will proceed with the development and implementation of a shellfish cultivation leasing program on underwater lands in Peconic and Gardiners Bays in accordance with the requirements of State law. New York Environmental Conservation Law §13-0302 ("2004 Leasing Law"), enacted on September 14, 2004, streamlines the cession of +/- 100,000 acres of underwater lands in Peconic and Gardiners Bays to Suffolk County for the purposes of establishing a shellfish cultivation leasing program consistent with modern conservation principles. The 2004 Leasing Law includes a sunset provision, stating that if no leases have been executed by December 31, 2010, then the authority of Suffolk County to issue such leases shall terminate, and the County will forfeit any title to the underwater lands in Peconic and Gardiners Bays. The Suffolk County Department of Planning has been given the responsibility to execute this shellfish aquaculture leasing program with the assistance of the County Executive-appointed Aquaculture Lease Program Advisory Committee (ALPAC).
